Seth Terms and Conditions

1. ACCEPTANCE OF TERMS

Welcome to Seth (“App”), an AI-powered faith companion developed by Bluesky Technologies Company.

By downloading, accessing, or using Seth, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, you must immediately stop using and uninstall the App.

2. ELIGIBILITY

You must be at least 13 years of age (or the age of digital consent in your jurisdiction) to use Seth.

If you are under 18, you represent that you have obtained permission from a parent or guardian to use the App and that they have reviewed and agreed to these Terms on your behalf.

If you are under 13 (or the applicable digital consent age in your region), you should use Seth only with the involvement and consent of a parent or legal guardian.

3. LICENSE AND USE

3.1 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use Seth for personal, non-commercial purposes on devices you own or control.

3.2 Restrictions

You agree NOT to:

• Modify, reverse engineer, or create derivative works of the App
• Attempt to extract source code or underlying AI systems
• Use the App for unlawful, harmful, fraudulent, or abusive purposes
• Use Seth to harass, impersonate, threaten, or harm others
• Use automated systems such as bots or scrapers with the App
• Upload malicious, illegal, or infringing content

4. PRIVACY AND DATA CONSENT

Your use of Seth is governed by our Privacy & Consent Statement, which is incorporated into these Terms by reference.

By using Seth’s AI-powered features, you explicitly consent to the processing of prompts, conversations, prayer entries, and submitted content for the purpose of generating AI responses and personalized experiences.

5. INTELLECTUAL PROPERTY

5.1 Our Ownership

Seth, including its software, AI systems, designs, branding, graphics, interfaces, features, and underlying technology, is the exclusive property of Bluesky Technologies Company or its licensors and is protected under applicable intellectual property laws.

5.2 User Content

“User Content” includes:

• Messages
• Prayer points
• Journal entries
• Saved notes
• Uploaded content
• Conversations with Seth

You retain ownership of your User Content.

By submitting content through the App, you grant us a limited, worldwide, royalty-free license to process, store, and analyze that content solely for:

• Providing App functionality
• Generating AI responses
• Syncing content across devices
• Improving platform reliability and personalization

This license terminates when your content is deleted from our systems, except where retention is legally required.

5.3 AI Outputs

Responses, devotionals, recommendations, and generated content produced by Seth (“Outputs”) are generated using AI systems and may not always be accurate, complete, or suitable for every situation.

You may use Outputs for personal, non-commercial purposes.

The underlying AI systems, algorithms, and platform technology remain our intellectual property.

6. DISCLAIMERS AND LIMITATION OF LIABILITY

6.1 “As Is” Service

SETH IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AVAILABILITY, OR NON-INFRINGEMENT.

WE DO NOT GUARANTEE THAT:

• THE APP WILL BE UNINTERRUPTED OR ERROR-FREE
• AI RESPONSES WILL ALWAYS BE ACCURATE
• GENERATED CONTENT WILL MEET YOUR EXPECTATIONS

6.2 Not Professional, Medical, or Pastoral Advice

Seth is intended for informational, devotional, inspirational, and spiritual support purposes only.

The App does NOT provide:

• Medical advice
• Mental health treatment
• Crisis intervention
• Professional counseling
• Licensed pastoral care
• Legal or financial advice

You should seek qualified professional assistance for medical, psychological, legal, financial, or emergency concerns.

You are solely responsible for decisions or actions taken based on content generated by the App.

6.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUESKY TECHNOLOGIES COMPANY, ITS DIRECTORS, EMPLOYEES, AFFILIATES, OR AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE APP.

THIS INCLUDES, BUT IS NOT LIMITED TO:

• LOSS OF DATA
• INTERRUPTIONS IN SERVICE
• RELIANCE ON AI RESPONSES
• EMOTIONAL DISTRESS
• SPIRITUAL DECISIONS
• SUBSCRIPTION PURCHASES

OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF:

• THE AMOUNT YOU PAID US IN THE LAST 12 MONTHS
• OR $10 USD

7. USER CONDUCT AND RESPONSIBILITIES

You are solely responsible for:

• Your use of the App
• The content you submit
• Maintaining your account security
• Any reliance placed on AI-generated responses

You agree not to upload or share content that is:

• Illegal
• Threatening
• Defamatory
• Obscene
• Harmful
• Infringing on intellectual property rights

We reserve the right to remove content or suspend accounts that violate these Terms.

8. SUBSCRIPTIONS AND PAYMENTS (IF APPLICABLE)

8.1 Subscription Terms

Seth may offer premium features through auto-renewable subscriptions.

If you purchase a subscription:

• Payment will be charged to your App Store or Google Play account upon confirmation
• Subscriptions automatically renew unless canceled at least 24 hours before the current billing period ends
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage subscriptions and disable auto-renewal in your device account settings
• Refunds are subject to the policies of the platform provider and applicable law

8.2 Free Trials

If offered, free trial eligibility is determined solely by the platform provider and may be limited to one trial per user or account.

9. TERMINATION

We may suspend or terminate your access to Seth at any time, without prior notice, if you violate these Terms or misuse the App.

Upon termination:

• Your right to use the App immediately ceases
• Certain provisions of these Terms will survive termination by their nature

10. MODIFICATIONS

We reserve the right to modify, update, suspend, or discontinue Seth or these Terms at any time.

We may provide notice of significant changes through the App or via email.

Your continued use of Seth after updates constitutes acceptance of the revised Terms.

11. THIRD-PARTY SERVICES

Seth may integrate with or rely on third-party services, including:

• AI infrastructure providers
• Cloud hosting providers
• Analytics services
• Payment processors

We are not responsible for the availability, content, or practices of third-party services.

Your use of such services may also be governed by their own terms and privacy policies.

12. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by the laws of the applicable jurisdiction in which Bluesky Technologies Company operates, without regard to conflict of law principles.

Any disputes arising from these Terms shall be resolved in courts of competent jurisdiction.

If you reside in a jurisdiction with consumer protection laws, you retain any mandatory rights available under those laws.

14. ENTIRE AGREEMENT

These Terms, together with the Privacy & Consent Statement, constitute the complete agreement between you and Bluesky Technologies Company regarding Seth and supersede all prior agreements or understandings.
